Maybe I'm reading this wrong, but they waited until afterwards to inform you and get your permission?
& frankly I prefer it that way - knowing that I'm being recorded tends to diminish my performance, it's one reason you don't hear more new/rare stuff at shows - I look out & see cell phone cameras pointing & the air kinda goes outta me

The setlist is a bit of a touchy subject. John stated that he didn't want people complaining with a new tour and new music rolling out that they didn't get the same songs as the San Francisco crowd. And its understandable, the man's not Wayne Newton; tying him to some of those songs too closely diminishes a lot of the verve of the band.
